Effective Date: March 5, 2026
This User Agreement ("Agreement") is a legal contract between you ("User" or "you") and Wallpaper 4K: HD & Live ("we", "us", or "our") governing your use of the Wallpaper 4K: HD & Live mobile application (the "App"), a pure utility app available on Google Play. By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, please do not download, install, or use the App.
We grant you a non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device, solely for your own personal, non-commercial use, in compliance with this Agreement and all applicable laws and regulations.
The App is a pure utility app with no login or payment functions. You acknowledge and agree that:
- You will not use the App for any illegal, unauthorized, or prohibited purpose, including but not limited to violating any applicable laws, regulations, or third-party rights.
- You will not modify, reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, or create derivative works based on the App.
- You will not interfere with or disrupt the App's functionality, servers, or networks associated with the App, including but not limited to using malware, viruses, or other harmful code.
- You will not share, lend, or distribute the App to any third party, or use the App on multiple devices beyond your personal use.
The App integrates TopOn, an ad mediation platform that serves ads from third-party ad networks (including AdMob and Meta Ads etc.). You acknowledge and agree that:
- In-app ads are part of the App's functionality, and we may display ads to you while you use the App.
- Third-party ad networks may collect non-personal information (as described in the Privacy Policy) to deliver relevant ads. We are not responsible for the content of third-party ads or the privacy practices of these ad networks.
- You may choose to interact with ads at your own discretion, but we are not liable for any damages or losses resulting from your interaction with third-party ads.
The App uses third-party tools (including TopOn for ad mediation, Adjust for attribution, AdMob, and Meta Ads etc. for ad serving) to operate and improve the App. You acknowledge that:
- This Agreement does not govern the use of third-party services, and you are subject to the terms and privacy policies of those third parties.
- We are not responsible for the performance, reliability, or security of third-party services, and we shall not be liable for any damages or losses resulting from the use of such services.
All intellectual property rights in the App (including but not limited to copyrights, trademarks, patents, trade secrets, and design rights) are owned by us or our licensors. This Agreement does not transfer any intellectual property rights to you, and you shall not claim any ownership rights in the App or its content.
The App is provided "as is" and "as available" without any warranties of any kind, express or implied. We disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the App will be error-free, uninterrupted, or secure.
- Warranties regarding the accuracy, completeness, or reliability of any content or information provided through the App.
We do not guarantee that the App will work on all devices or operating systems, or that any errors in the App will be corrected.
To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages (including but not limited to damages for loss of profits, data, or use) arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages. This limitation of liability applies regardless of the cause of action, whether in contract, tort, negligence, or otherwise.
We may terminate this Agreement and your license to use the App at any time, without prior notice, if you violate any terms of this Agreement. Upon termination, you must immediately uninstall and cease using the App. Sections 5 (Intellectual Property Rights), 6 (Disclaimers of Warranties), 7 (Limitation of Liability), 9 (Governing Law), and 10 (Contact Us) shall survive termination.
This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles. Any disputes arising out of or in connection with this Agreement shall be resolved in the courts of California, United States.
We may update this Agreement from time to time to reflect changes in our practices or applicable laws. We will notify you of any material changes by updating the "Effective Date" at the top of this Agreement and, where required by law, through in-app notifications or other means. Your continued use of the App after the update constitutes your acceptance of the revised Agreement.
